Terms of Service

These terms govern the use of Ripple, a hyperlocal news app where users post reports tied to a place and the nearby community confirms or disputes them. By creating an account or using the app you accept these terms; if you do not accept them, do not use Ripple.

1. Who provides the service

The service is provided by Alessio Danna, whose contact address is Carrer Mas 40, 08903 L'Hospitalet de Llobregat (Barcelona), Spain (hereinafter "Ripple", "we").

2. Acceptance and changes

On first launch the app asks for explicit acceptance of these terms, together with the age declaration and the acceptance of the privacy policy. Each version of these terms is identified by a version date (at the top of the document). In the event of substantial changes, the app asks you to accept the new version before you can continue using the service.

3. Age requirement

Ripple is reserved for people who are at least 16 years old. By signing up you declare that you are at least 16. If we become aware that an account belongs to a younger person, we close the account and delete its data as set out in the privacy policy.

4. Account

• To use Ripple you must create an account with a valid email address (or through a supported sign-in provider) and choose a public nickname.
• You may create only one personal account; automated or shared accounts are not allowed.
• You are responsible for keeping your credentials safe and for everything that happens through your account.
• The nickname must not infringe the rights of others nor impersonate other people or organizations.
• You can delete your account at any time from the app, under Settings → Privacy section → Delete account. The effects of deletion are described in the privacy policy.

5. User content and license

• The content you post (news items, texts, photos, comments) remains yours.
• By posting content you grant Ripple a non-exclusive, royalty-free, worldwide license to host, reproduce, display and distribute that content within the app and its associated services, for the sole purpose of providing the service (for example showing your news item to nearby users or sending notifications that mention it).
• The license lasts for as long as the content remains published. If you delete your account, the content that remains visible in anonymous form (as described in the privacy policy) continues to be covered by the license to the same limited extent.
• You warrant that you hold all the rights needed for the content you post and that it does not break the law or infringe the rights of third parties.

6. Rules of conduct

By using Ripple you agree not to:

• post illegal content or content that infringes the rights of third parties (including copyright and image rights);
• post offensive, violent, hateful, sexually explicit content or content that reveals other people's personal data;
• impersonate other people, organizations or authorities;
• harass, intimidate or stalk other users;
• post deliberately false or misleading news;
• spam, post unsolicited advertising or repetitive self-promotion;
• fake or manipulate your location (GPS spoofing) to post, vote or interact from a place where you are not;
• interfere with the technical operation of the service, circumvent the moderation systems or the rate limits, or collect other users' data in an automated way.

The detailed rules on what is welcome and what is prohibited are in the Community Guidelines, which form an integral part of these terms.

7. Zero tolerance for objectionable content and abusive users

Ripple applies a zero-tolerance policy towards objectionable content and towards users who behave abusively. In practice:

• all text content passes an automated moderation check at the time of publication;
• every news item and every comment can be reported in-app; every user can be blocked in-app;
• we review reported content and, if it violates these terms or the guidelines, we remove it within 24 hours of the report and eject the user who posted it.

8. Reports and blocking users

• You can report a news item or a comment from the content's ⋯ menu.
• You can block a user from their author profile in a news item or from the menu of one of their comments. A blocked user will no longer see your content in their feed and you will no longer see theirs.
• A sufficient number of reports automatically hides the content pending review by the administrators.

9. Suspension and ejection

We may suspend or close your account, with immediate effect, if you violate these terms or the community guidelines, in particular in the cases described in section 7. In the event of serious or repeated violations, the ejection is permanent. If you believe a measure is wrong, you can contest it by writing to alessio.danna.94@gmail.com.

10. Reputation and verification status

The "verified" or "disputed" status of a news item derives from the votes of the nearby community and from the users' reputation scores. It is a community mechanism: the verification status is not a guarantee of truth and does not constitute a confirmation on our part.

11. Responsibility for content and limitation of liability

• News items and comments are posted by users, who are solely responsible for them. Ripple hosts the content and does not adopt it as its own, nor does it guarantee its accuracy, completeness or timeliness.
• The service is provided as a beta version, "as is" and "as available", with no guarantee of continuity or freedom from errors.
• To the maximum extent permitted by law, we are not liable for damage arising from content posted by users or from reliance placed on it, nor for indirect damage arising from the use of the service.
• Nothing in these terms excludes or limits liability for wilful misconduct or gross negligence, nor the rights you hold mandatorily as a consumer.

12. Intellectual property

The app, its code, the Ripple name, logo and graphics are owned by us or by our licensors. These terms do not transfer any rights over them to you, except the personal, non-exclusive right to use the app in accordance with these terms.

13. Duration and termination of the service

You can stop using Ripple and delete your account at any time. During the beta we may suspend or terminate the service, in whole or in part; where reasonably possible, we will give advance notice in the app.

14. Communications

We may send you communications about the service (for example notices about changes to these terms or about measures affecting your account) through the app or to the email address associated with your account.

15. General provisions

• If a clause of these terms proves invalid or unenforceable, the others remain fully effective.
• Our failure to enforce a clause does not constitute a waiver of the right to enforce it later.
• The account is personal: you may not transfer the account or the rights arising from these terms to third parties.
• These terms, together with the privacy policy and the community guidelines, constitute the entire agreement between you and us on the use of the app.

16. Governing law and jurisdiction

These terms are governed by Spanish law. Any dispute falls under the jurisdiction of the courts of Barcelona (Spain), without prejudice to the mandatory consumer-protection rules, which may allow you to bring proceedings before the courts of your place of residence.
